1. Overview
These Terms and Conditions govern your use of totalapexmerch.com and every order you place with Total Apex Merch (“we”, “us”, “our”). By placing an order or using this site, you agree to these terms. If you do not agree, please do not use the site or place an order.
2. Orders and acceptance
When you place an order you are making an offer to buy. Your order is accepted when we send an order confirmation email. We may decline or cancel any order, for example because of a pricing error, a product that is no longer available, or a suspected fraudulent payment. If we cancel an order after you have paid, we will refund you in full.
3. Prices, payment and sales tax
All prices are in US dollars. We accept major credit and debit cards, Apple Pay and Google Pay through our card processor, and PayPal. Your payment is charged when you place your order. Card and PayPal details are handled by those providers; we never see or store your full card number. Sales tax is calculated at checkout where required and shown before you pay, along with shipping.
4. Made to order
Our products are produced on demand after you order. Because each item is made specifically for you, production usually takes a few business days before the item ships. Estimated delivery dates shown at checkout are estimates, not guarantees, and may be affected by carrier delays, holidays and weather.
5. Shipping
We currently ship within the United States. The shipping options and costs are shown at checkout once you enter your address. You are responsible for entering a correct and complete shipping address. If a package is returned to us because of an incorrect address or because it was not claimed, you may be charged to have it sent again. Risk of loss passes to you when the carrier delivers the package to the address you gave us.
6. Returns, exchanges and refunds
Because items are made to order, we cannot accept returns or exchanges for change of mind, or for the wrong size or color ordered. Please check the size information and product details before you order.
If your item arrives damaged, defective or misprinted, or if we sent the wrong item, contact us within 30 days of delivery at the email address below. Include your order number and clear photos of the problem. After we review your request we will send a replacement or issue a refund, whichever you prefer. You do not need to send the item back unless we ask you to.
Approved refunds go back to the original payment method. Banks and card issuers can take several business days to show the credit.
7. Order changes and cancellations
Production begins quickly. If you need to change or cancel an order, email us as soon as possible with your order number. We can cancel or change an order only if it has not yet gone into production. Once production starts we cannot cancel it.
8. Product colors and appearance
We work hard to show our products accurately, but colors on your screen may differ from the finished item because of screen settings, lighting and the printing or embroidery process. Small variations in placement and size of artwork can occur from item to item and are not considered defects.
9. Intellectual property
All logos, artwork, designs, text and images on this site belong to Total Apex or are used with permission. You may not copy, reproduce or use them for commercial purposes without our written permission. Buying a product does not give you any right to reproduce its designs.
10. Brand names
Some products are blank garments made by well-known apparel brands that we decorate with our own artwork. Those brand names are the property of their owners. We are not owned by, sponsored by or affiliated with those brands.
11. Use of the site
You agree to use this site only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access, or submit false information. We may suspend or block access to anyone who misuses the site.
12. Limitation of liability
We provide the site and our products on an “as is” and “as available” basis. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the site or products, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these terms limits any rights you have under applicable consumer protection law that cannot be waived.
13. Governing law
These terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Ohio, unless the law of your state requires otherwise.
14. Changes to these terms
We may update these terms from time to time. The version posted on this page when you place your order is the one that applies to that order.
